received no complaints concerning the material on my site and would have

You told me that Mr David Braben had complained to you concerning the
material on my site. I asked you to put the details of this complaint in
writing and you have not yet done so. I refer you to my previous email.

A recent public announcement by Mr Braben (Article: 30740 of
alt.fan.elite) includes:

This suggests i may not have received some messages which you may have

As you may be aware there has been correspondance between CIX and myself
recently (attached) culminating in CIX's withdrawl of my webspace.

David Braben has publically reported (copies attached) that

Such statements are false and defamatory. I'd be grateful if you could
look into this matter and confirm or deny whether such statements were
made by CIX or not.

(8) Why has the CIX/~ibell site disappeared?

I wanted to make the Elite binaries available as part of the possible
forthcoming Elite Club and wanted to check the
current status of the old Elite binaries. These were available on a site
under the "Ian Bell" name, with CIX as the
service provider. I did not know whether the ibell CIX account had not
also been sold, possibly to a different
person, so I asked CIX for the identity of the site holder, since the
real Ian Bell had not responded to mail sent by
surface post to his last known address. CIX needed the permission of the
site holder to reveal their true identity so
an enpasse existed for three months while the site holder did not respond
to CIX's emails. Out of desperation, and
after discussion with CIX, I thought that a threat to ask for the Elite
files to be removed might prompt a response,
and so CIX asked the account holder to remove the files. The site holder
responded by posting a small number of
purported emails from CIX to the site, which CIX told me were only a
small part of a correspondence and as such
these mails completely misrepresented what had actually been said. This
also gave out the private email addresses of
various CIX staff, and painted both CIX and myself in a very bad light. I
understand it was this that caused removal
of the entire ibell web space as it broke the terms and conditions of the
account.

There was a long discussion thread about this on alt.fan.elite,
culminating in articles appearing on a number of
magazine websites, which were later withdrawn following speaking to
myself and a representative of CIX, and I
distributed a press release about this.

I stand by both. The FAQ and the press release (which is shortcutted from
the FAQ anyway) are the same. Both CIX & I thought a threat to remove the
Elite site would trigger a response - the purported emails sealed CIX's
decision, and they removed the whole ibell web space. I don't deny that if
the dodgy mails had not appeared on the site then CIX would probably have
carried out my threat eventually, but this would probably have only been
the
Elite site.

You seem to have forgotten that the original purpose of this fiasco was to
put the Elite files on our site here. I am still awaiting a response from
the site holder.

The FAQ is intended to clarify things, and avoid this thread continuing
indefinitely in the stupid Derek Smart flamewar style. I have posted here
as
it concerns the faq, but I will not keep posting on this question. I
suggest
people go to the faq instead.

Hi,

On 9/9/99 CIX suspended access to my webspace at two days notice on the
basis of an alledged undisclosed complaint by David Braben.

Since then Mark Wilson agreed to restore my site if given a written
undertaking from myself that certain materials would not be uploaded,
which i provided last month.

In an email of 20/10/99 (attached below) Mark Wilson promised to restore
my site during the following week. This he failed to do and he is not now
responding to my emails.

Can you please restore access to my webspace?

My links have now been broken for two months.

If by this you mean the email log previously webposted at
www.cix.co.uk/~ibell/elite/incoming.htm then I reject your description of
these as "purported".

If the public statements of Mr David Braben brought to your attention
in previous emails are to be believed, this is at least the second time
a "director of CIX" has alleged or implied this email log to be other
than a complete and accurate record of the emails between CIX and myself
to 08/09/99 on the matter of the www.cix.co.uk/~ibell website.

This is a matter I take very seriously, considering the implication
that I have webposted a "bogus" email log to be both false and
defamatory.

You are presumably able to consult your own records to verify the
authenticity or otherwise of this email log - as I requested you to do
in my email of 12/09/99.

I insist that you either confirm the accuracy of the webposted email
log or substantiate CIX's apparently repeated defamatory allegations to

I note that your reply to my email of 08/09/99 in which I asked
"Please specify precisely which files you wish removed."
did *not* request the removal of any files containing emails.

I note that on 06/12/99 CIX appear to have twice removed a file from my
webspace without notification, then publicly falsely implied in
cix:cix.support/4internet:2491 that I was informed by CIX of its
actions.

I have recieved no responce to either my email of 16/12/99 [quoted above]
or my request in cix.support/4internet 2282 for confirmation
of whether the covert tampering with my webspace of 6/12/99
was official CIX action or the work of a cracker.

Accordingly, i wish to close my CIX account.

I have replaced all the files in my webspace with a small set of minimal
referral pages to a new hosting (www.ibell.co.uk) and would appreciate it
if you could maintain these referral pages on your server.

If you provide email forwarding for closed accounts, my preferred address
